What is Mediation?  Why Mediate?

A divorce is a stressful time for all parties involved.  It is not just filing divorce papers.  There are so many emotions that have to be worked through -- sorrow, shame, anger, denial, and guilt.  If you are facing a divorce, or a separation, at times you may feel that you have no control over your life.

Family Law Mediation can help you take control back.  A less adversarial setting than a courtroom.  With the help of an experienced neutral Mediator as a facilitator, family law mediation allows you and your partner to determine the issues you are facing.  Your issues of concern may include divorce, separation, child custody, parenting plans, child support, alimony, equitable distribution, prenuptial agreement, cohabitation agreement, LGBT issues, and any other issues of concern.

Once your issues are listed, you and your partner will each have the opportunity to discuss your viewpoints and concerns regarding each.  With the help of the Mediator, you can work on an overall agreement that addresses concerns, and that you each feel will work best for your situation.

By amicably addressing your issues, and working together, you will not only save money compared to traditional legal proceedings, but also save on feelings that are often further damaged during the course of litigation and traditional negotiations.

Mediation is not for divorce proceedings only.  Most domestic relations issues can be addressed in Mediation, including issues for married and non-married couples and families. Addressing issues for LGBT families and couples. Mediation may also be appropriate whenever there are interpersonal issues in conflict.

What Documents to gather to bring to Mediation:

If you would like to start pulling together documents that will be helpful during the Mediation process, the following is a list of the categories of documents:

  • Income information - recent pay stubs, last tax return, last W-2s, 1099s, etc.
  • Asset information - copies of most recent statements and /or a list of assets
  • Debt information - copies of most recent statements and /or a list of debts
  • Insurance information - you will need this when filing with court, but for the purpose of Mediation - Life Insurance information and Health Insurance information (cost to cover children).
  • Employment-based benefits - including any retirement plans, savings plans, or other benefits
  • Expense / Budget information - monthly living expenses.
  • Other documents you feel may be important to review.

Note:  Please do not worry too much if you are unable to pull any or all of this information together prior to your introduction appointment.  We can proceed either way.
